RISK, SAFETY AND LIABILITY
Traveler understands that the social, cultural, political, religious, governmental, health care, legal (both civil and criminal) and other systems, as well as the geophysical characteristics, of foreign countries may be different, in subtle and/or significant ways, from those in the United States. For example, behavior that is considered normal or acceptable in the United States, may be illegal, socially or culturally unacceptable, or offensive outside the United States and may result in penalty, fines or imprisonment. Traveler understands that police, fire and other governmental systems may be inadequate by U.S. standards in certain countries, and that the quality and availability of health care may be very different than what is typically available in the United States. Finally, traveler is aware that certain activities carry increased levels of risk by their nature (for example strenuous physical
activity, sea travel, etc.)
Traveler understands that travel, both inside and outside the United States of America, involves risk of personal injury, death, or property damage. Traveler understands that certain risks are inherent in foreign travel and fully accept those risks which may include, but are not limited to, war, quarantine, civil unrest, disobedience or terrorism, public health risks, exposure to communicable diseases, wild and domestic animals, criminal activity such as assault, kidnapping and theft, adverse weather conditions and natural disasters such as earthquakes, volcanoes, windstorms and floods, animal attack, insect and animal bites, ill effects of unfamiliar food and water, incidents related to ground, air or water transportation to include motor vehicle collisions and plane crashes, injuries or damage to property, and other physical, mental, and emotional injury. Traveler fully assumes personal responsibility for the consequences of the enumerated risks, including the risk of catastrophic injury or death, and all other potential hazards which may arise in connection with my travel abroad, which may result in injury, death, or damage to property.
She Is Wildly Free encourages traveler to review applicable current travel advisories issued by the U.S. Department of State http://travel.state.gov and the Center for Disease Control http://www.cdc.gov relating to all foreign destinations listed above. Traveler acknowledges that She Is Wildly Free has urged traveler to consult these advisories again within 24 hours of departure.
Traveler understands that, although She Is Wildly Free has made every reasonable effort to assure my safety while participating in the trip, there are unavoidable risks. Traveler understands that She Is Wildly Free is not responsible for my safety and knowingly and voluntarily agrees to assume any and all risks associated with participation in the She Is Wildly Free experience. Traveler also acknowledges that participation is optional and that traveler participation would not have been permitted without agreement to the Terms and Conditions.
To the maximum extent permitted by law, Traveler releases She Is Wildly Free, their trustees, officers, faculty, employees, representatives, agents, or anyone accompanying this trip, or their heirs or estates, in their official and individual capacities (collectively, She Is Wildly Free) from, and agree not to sue She Is Wildly Free, any and all claims and causes of action for loss of or damage to property, bodily or personal injury, loss of companionship or support, or death sustained by me or third parties arising out of any activity or travel associated with my participation in the trip.
Traveler agrees to defend, indemnify and hold harmless She Is Wildly Free for any and all losses, expenses, claims, judgments and liabilities (including attorneys’ fees) of any nature arising out of, or in consequence of, my acts, words, conduct, etc. in connection with the trip including, but not limited to, damage to property, any injuries or death sustained by any person(s) as a result of my actions or inactivity. Traveler further acknowledges that nothing stated herein shall relieve traveler from my obligation to uphold and support all rules and regulations for participation in the She Is Wildly Free experience, as set forth by She Is Wildly Free.
Traveler understand that it is within She Is Wildly Frees discretion to change travel, accommodations, and other arrangements as it deems necessary. Traveler understands that She Is Wildly Free is not responsible for nor does it represent or act as agent for host institution or service providers, including those who provide transportation, tour, dining or sleeping accommodations. Therefore She Is Wildly Free cannot control the acts or omissions of host institutions or service providers.
Traveler acknowledges that she has no known physical or health-related reasons or problems that preclude or restrict my participation in the trip, or has disclosed to She Is Wildly Free any physical, mental, and emotional conditions or problems, permanent or temporary, including special dietary and medication needs, or the need for visual or auditory aids that might impair my ability to participate in the trip, and releases She Is Wildly Free from any and all claims, damages, injuries (including death), or loss arising out of my failure to disclose such conditions or problems.
COVID-19 POLICY
She Is Wildly Free has and reserves the right to cancel or terminate any trip at any time, in its sole discretion and at its sole determination. She Is Wildly Free shall be able to cancel any trip for any reason or sole discretion, including, but not limited to: global pandemics/diseases, natural disasters, border closings/quarantines, acts of God, acts of war/terrorism, civil unrest or turmoil in the country or reason.
In the event that a trip is cancelled, for any reason, She Is Wildly Free will not issue refunds of any payments made for any reason. Traveler will only be entitled to a travel credit in the amount paid that can be used toward a future trip occurring within designated time frame. If a Traveler elects not to attend a trip for any reason other than She Is Wildly Frees cancelling the trip, the payment rules and provisions as stated in other sections of the Terms and Conditions presented above will prevail.
If any trip is cancelled, She Is Wildly Free will communicate this to travelers via email. Travelers are responsible for ensuring that they are checking their email and receiving emails from She Is Wildly Free. She Is Wildly Free is not obligated to give any other form of notice of trip cancellation. She Is Wildly Free will keep traveler updated in a timely manner, and if there is no notification as to cancellation traveler can proceed as planned.
Traveler understands and acknowledges that international travel is an ever-changing situation and She Is Wildly Free will do its best to keep attendees reasonably informed of any changes that may affect the trip, for any of the reasons detailed above. She Is Wildly Free will closely monitor and will likely cancel any affected trip if the travel advisory for the country in which any portion of the trip occurs reaches a “Level 3” travel advisory within 6 weeks of the trip. She Is Wildly Free has the right to cancel any trip even if it does not involve a travel advisory of Level 3, as well.
Traveler may be required to submit a negative COVID-19 test prior to travel or upon arrival. Traveler is responsible for the costs associated with this test and ensuring that she receives the required form of the test.
Traveler may be required to submit a negative COVID-19 test prior to returning home or upon arrival in home destination. Traveler is responsible for all costs associated with this test and ensuring that she receive the required form of the test with appropriate documentation.
Traveler understand and acknowledges that some locations have a vaccination requirement. Booking a trip indicates that traveler understands that a vaccination may be required. She Is Wildly Free will not reimburse individuals who choose not to be vaccinated if their intended destination has a requirement.
PHOTOGRAPHY AND VIDEOGRAPHY
Photos and video may be taken during this trip. Traveler gives She Is Wildly Free the right to take, alter, edit, copy, publish and make use of any and all pictures and video taken of me to be used in and/or for promotional materials including, but not limited to social media, newsletters, flyers, websites and digital communications without payment or any other consideration.
PASSPORT, VISA AND TRAVEL ENTRY REQUIREMENTS
A passport valid for 6 months after the final trip date is required for international travel. She Is Wildly Free is not responsible for any losses or delays resulting from expired or invalid passports.
Passport information and copies should be submitted to She Is Wildly Free at least 4 weeks prior to departure.
Traveler is responsible for obtaining any additional visas or documents, if applicable.
Traveler understands that, due to COVID-19, other travel documents may be required. Traveler is responsible for obtaining and submitting these documents by their due date.
